Petitioner, pro se, alleged that the City violated NYCCBL § 12-306(a)(3) by withholding work assignments and interfering with the timely processing of her timesheets. Petitioner also alleged that the Union violated NYCCBL §§ 12-306(b)(1) and (3) by refusing to request a transfer and file a grievance regarding her lack of assignments, failing to adequately represent her regarding her tasks and standards, and ignoring her timesheet processing issue. The City argued that Petitioner failed to allege a prima facie case of retaliation. The Union and the City separately argued that the Union did not breach its duty of fair representation. The Board found that neither the City nor the Union violated the NYCCBL. Accordingly, the petition was dismissed.
