Petitioners alleged that the Respondents violated the NYCCBL by improperly entering into an agreement in 2014 to commit to achieving citywide healthcare savings. The Executive Secretary dismissed the petition on the grounds that all the claims were untimely. Petitioners appealed, arguing that the Executive Secretary’s dismissal was in error. The Board found that the Executive Secretary properly deemed the petition untimely and dismissed the petition. The Board further dismissed the petition for lack of standing and for failure to state a claim under the NYCCBL.
