Petitioner claimed that the Union breached its duty of fair representation in violation of NYCCBL § 12-306(b)(3) by failing to adequately represent him during a disciplinary investigation. The Union argued that it did not breach its duty of fair representation because Petitioner was not entitled to the due process protections of the collective bargaining agreement or the Civil Service Law. The Board found that the petition was untimely. Accordingly, the petition was dismissed.
